Terms of Service

Please read these Terms of Service (“Terms”) carefully before using EST8 (est8.app). By creating an account or using the service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using EST8, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to be bound by them. If you are using EST8 on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

EST8 is a cloud-based Customer Relationship Management (CRM) platform designed for real estate professionals. The service includes property management, contact management, transaction tracking, AI-powered tools, and related features. EST8 is provided on a software-as-a-service basis.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account, whether or not authorised by you.
  • Promptly notifying us of any unauthorised access or security breach at legal@est8.app.
  • Providing accurate and up-to-date account information.

4. Acceptable Use

You agree not to:

  • Use EST8 for any unlawful purpose or in violation of applicable regulations.
  • Upload or transmit viruses, malware, or any harmful code.
  • Attempt to gain unauthorised access to any part of the service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the platform.
  • Resell, sublicense, or otherwise commercialise the service without our written consent.
  • Use automated tools (bots, scrapers) to access the service in a way that burdens our infrastructure.

5. Payment Terms

EST8 operates on a monthly subscription model. The following terms apply:

  • Subscriptions are billed monthly in advance on the date you first subscribe.
  • Payment is processed securely via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • No refunds are issued for partial months. If you cancel mid-month, you retain access until the end of that billing period.
  • We reserve the right to change pricing with 30 days’ notice. Continued use after a price change constitutes acceptance.

6. Intellectual Property

EST8 and all associated intellectual property — including the software, design, trademarks, and content — are owned by EST8 and its licensors. These Terms do not transfer any ownership to you. You are granted a limited, non-exclusive, non-transferable licence to use the service solely as described in these Terms.

Your data remains yours. You grant EST8 a limited licence to process your data solely to provide the service.

7. Disclaimers

EST8 is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, EST8 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the service. Our total liability to you for any claim shall not exceed the amount you paid to EST8 in the three months preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate your account at any time if you breach these Terms or engage in conduct we reasonably believe is harmful to the service or other users. You may terminate your account at any time by cancelling your subscription and deleting your account from settings. Upon termination, your right to use the service ceases immediately.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the service after the effective date constitutes your acceptance of the revised Terms.
